AGB´s (en)
Originally developed in the German AGB-law rules to the T & C were as Directive 93/13/EEC [1] largely adopted into European Community law. This directive requires member states to adopt certain legal standards that protect consumers against unfair terms and conditions clauses. In all EU countries, one can therefore expect a consumer to the fact that entrepreneurs as a user of terms similar in principle (though not identical!) Restrictions as in Germany. A new EU regulation, which will lead to a complete unification of the AGB-law (so-called maximum harmonization), is currently being prepared.
The non-EU country, Switzerland has been no explicit statutory provision of the Terms, but the courts and the literature by a concretization of general rules (good faith) an induced in many ways comparable state law. It is not excluded that are created in Switzerland in the years to specific legal regulations.
